By creating an account or using PromptVault ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our Service.

These Terms constitute a legally binding agreement between you and PromptVault. We may update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

PromptVault provides:

• A curated library of AI prompt templates
• Access to prompts for various AI platforms (ChatGPT, Claude, Midjourney, etc.)
• Free tier with limited prompt access
• Paid subscription for full access to all prompts and features

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of unauthorized access
• Accept responsibility for all activity under your account

3.2 Account Requirements

• You must be at least 16 years old to use our Service
• One account per person; account sharing is prohibited
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payments

4.1 Free Tier

Free users may unlock a limited number of prompts at no cost. Free access is subject to change.

4.2 Paid Subscription

• Price: $9/month (subject to change with notice)
• Billing: Recurring monthly via Stripe
• Access: Unlimited access to all prompts and variations

4.3 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• No prorated refunds for partial months

4.4 Refunds

We offer a 100% money-back guarantee within the first 30 days of your initial subscription. Contact us at support@promptstash.online for refund requests.

5. Acceptable Use

5.1 You Agree NOT to:

• Use prompts to generate illegal, harmful, or malicious content
• Create content that promotes violence, hate speech, or discrimination
• Generate misleading or deceptive content (deepfakes, misinformation)
• Infringe on intellectual property rights of others
• Harass, abuse, or harm other individuals
• Attempt to reverse-engineer or redistribute our prompt library
• Use automated systems to scrape or copy our content
• Share your account credentials with others
• Resell or commercially redistribute our prompts without permission

5.2 Responsible AI Use

When using our prompts with AI systems, you agree to:

• Transparency: Disclose AI-generated content where required by law or platform policies
• Accuracy: Verify AI outputs before publishing or acting on them
• Fairness: Avoid using prompts to create biased or discriminatory content
• Safety: Not generate content that could cause harm to individuals or groups
• Accountability: Take responsibility for how you use AI-generated content

6. Intellectual Property

6.1 Our Content

PromptVault owns or licenses all content in our prompt library, including:

• Prompt templates and variations
• Website design and user interface
• Trademarks and branding
• Documentation and guides

6.2 Your License

Upon purchase or unlock, you receive a non-exclusive, personal license to:

• Use prompts for your own personal or business purposes
• Modify prompts for your specific needs
• Use AI outputs generated from our prompts commercially

6.3 Restrictions

You may NOT:

• Resell, redistribute, or share our prompts publicly
• Create competing products using our prompts
• Remove attribution or claim ownership of our original prompts

6.4 AI-Generated Output

Content you generate using our prompts with third-party AI services is subject to those services' terms. We make no claims to ownership of your AI-generated outputs.

7. Third-Party Services

Our prompts are designed for use with third-party AI platforms. We are not affiliated with:

• OpenAI (ChatGPT, DALL-E, GPT-4)
• Anthropic (Claude)
• Midjourney
• Other AI service providers

Your use of these services is governed by their respective terms and policies. We are not responsible for their availability, performance, or outputs.

8. Disclaimers

8.1 No Guarantees

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Specific results from using our prompts
• That prompts will work identically across all AI platforms
• Uninterrupted or error-free service
• That AI outputs will be accurate, legal, or suitable for any purpose

8.2 AI Output Responsibility

You are solely responsible for:

• Reviewing and verifying all AI-generated content
• Ensuring outputs comply with applicable laws
• Any consequences of publishing or using AI outputs

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PromptVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any third-party AI service failures or outputs

10. Indemnification

You agree to indemnify and hold harmless PromptVault from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you create using our prompts
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse our Service or other users

Upon termination, your right to access prompts ends immediately. Provisions that should survive termination (IP rights, disclaimers, limitations) will remain in effect.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@promptstash.online and attempt to resolve the dispute informally for at least 30 days.

12.2 Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of Delaware, unless otherwise required by your local consumer protection laws.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PromptVault.

13.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

13.3 No Waiver

Our failure to enforce any right does not waive future enforcement.

13.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor.
